âYeah, but letâs wait till the dust clears from the CSI unit.â She knelt down and looked at the tire tracks in the lawn. âSo, I heard it was Rachelâs husband that made this hole.â
âHis truck, anyway,â Fenway said, noncommittally. âHe says it was stolen.â
âYou question him yet?â
âMcVie did. I was keeping Rachel occupied, mostly. McVie arrested him for Walkerâs murder about ten minutes ago.â
Dez exhaled loudly. âUgh. Rachel must be beside herself. Probably wonât be seeing her today.â
âProbably not. She ran out.â
âWhat did they have on him?â
Fenway looked down at Dez. âWe have enough for suspicion. Motive. An alibi that didnât match up. A gun thatâs probably the same caliber as the murder weapon.â
âHmm.â Dez stood back up. âWe havenât seen the ballistics report yet. Iâll call the M.E. in San Miguelito first thing this morning.â
âYou have a good relationship with the M.E.?â
Dez looked at Fenway sideways. âWhatâs that supposed to mean?â
Fenway was a little taken aback. âI just meant I have some new territory to cover here, and if youâre on decent terms with the M.E., I might like you to introduce him to me.â
Dez relaxed. âYeah, weâre not on the best of terms, but Iâll see what I can do.â Dez put her arms above her head and stretched. âAnd itâs a her, by the way.â
âWhat?â
âThe M.E. Itâs a her, not a him.â
Fenway nodded. âOh, thatâs right. You said she was a bitch.â
Dez chuckled. âYep. I gotta tell you something else, Fenway. That drawer they stole was the F through G drawer in active files.â
Fenway closed her eyes. âLet me guess. Ferris Energy had some active files in there.â
âYep. But F through G covers a lot of ground. Dylanâs last name is Richards, like Rachelâs, right?â
âYeah.â
âWell, that ainât it,â Dez said.
âMaybe his momâs maiden name is Ferguson or Gatsby or something.â
âMaybe, but these are active cases.â
âYeah.â
âBut I know for a fact there was an active file in there on Ferris Energy. There were a couple of deaths there about six months ago, and Walker still hadnât determined a cause of death.â
âIt wouldnât have been under the last name of the deceased?â
âNot in Walkerâs filing system.â Dez shook her head. âWhen multiple deaths are related, Walker filed it under a group name. Two John Does found in Querido Park last year were filed under Q.â
They both fell silent, watching the CSI team carry out the last few pieces of furniture.
âIâm not going to sweep anything my father did under the rug,â Fenway said. âI donât know if thatâs why he suggested my name to McVie, but Iâm not hiding anything. My mom and I left my father twenty years ago, and Iâve barely talked to him. If I have to arrest him for murder, and I get run out of town, so be it. Itâs not like I have any ties here.â
Dez kept watching the CSI team, but she nodded slowly. âI like hearing youâre not going to give your father special treatment. But donât be putting him in maximum security yet. Thereâs nothing weâve found to tie him to anything.â
Fenway looked down at her feet. âYet.â
âAll right, I think we can go in now. Weâll figure out where they put everything, and you can go through it later.â
âLater?â Fenway stifled a yawn. âI already feel like Iâve been on the job for a full day.â
âAnd itâs not even eight a.m.â
They walked around to the front of the building, where Dez let them in with her keycard.
âI need to clue you in on something, Dez,â Fenway said, âand I know Iâve only known you a couple of days, but I have to trust somebody, and I think if you werenât trustworthy, youâd act differently around me.â
âWhat do you mean?â
Fenway raised her eyebrow. âYouâd be a lot nicer to me, for one thing.â
Dez laughed. âHoney, this is me being nice. Just ask the M.E. what my not-nice looks like.â She opened the door to the office suite and they went inside.
âOkay. So, this is delicate, and given what Iâm about to tell you, this whole thing is probably going to blow back on the county.â
âWhat are you talking about?â
âFirst, Dez, this is between you and me.â Fenway sat down at Rachelâs desk, Dez perched beside her. âNo Mark, no Migs. Donât even tell family members. Just you and me.â
âAll right.â
âItâs about Walker. Two nights before he was killed, he sexually assaulted Rachel in the office.â
âWhat?â Dez asked, incredulous. âWhat do you mean, âsexually assaultedâ?â
âHe ripped her clothes. Tried to rape her. When she fought to get away from him, he told her she was fired.â
âDid Rachel tell you that?â
Fenway nodded. âAnd itâs on video.â
Dez shook her head. âThat piece of shit. I knew he was a letch, but I didnât think heâd do that.â
âBut listen,â Fenway continued, âthereâs more. Walker had been harassing Rachel for weeks, and she went to Lana Cassidy, and Lana blew her off. Told her she needed proof, and she couldnât file a report based only on Rachelâs testimony.â
âThen he escalated from harassment to rape,â Dez spat. âAnd since Lana said she needed proof, Rachel recorded it?â
âYep.â
âAnd she told her husband, who went ballistic.â
âWell, maybe. I mean, Rachel says she didnât tell him, but she left a backup copy of the video on a USB stick in their junk drawer.â
âThatâs crazy. Why would she leave it there if she didnât want him to look at it?â
âShe says he wouldnât pay any attention to a random USB stick in a junk drawer. But you never know; Dylan might have found the drive and watched the video on it anyway. Thatâs certainly McVieâs working theoryâDylan watched the video, then lost his mind with rage, and lured Walker out to the woods to kill him.â
âYou donât think so, though.â Dez looked thoughtful.
Fenway hesitated. âIt would fit really well. Except, why take the files? And you can clearly see his license plate in the camerasâitâs almost like the driver of the truck wanted us to see the plate. The driver was wearing a ski mask, and knew enough to avoid the security cameras once he was out of the truck, but didnât think to remove the license plate?â
âSo, you think someone is framing Dylan.â
âI guess thatâs what I think. That sounds so crazy, like a conspiracy theory. Who would frame Dylan?â
âMaybe someone at his work? Maybe a family member?â
âI actually think McVie is looking to see if Rachelâs involved,â Fenway said. âBut if Dylan did it, maybe he could say it was the only way to prevent Walker from attacking her in the future. Rachel had already reported it to HR, but it didnât stop. If that were the case, I think itâs possible the county could be legally liable for Walkerâs murder.â
âWait.â Dez put up her hand to stop her. âI totally get the county is liable if Rachel wants to sue us for a zillion dollars. But Walker sexually assaults a girl at work, and his family can sue because the county let him get away with it?â
âYeah. Iâve seen this kind of thing happen in Seattle. A doctor in the ER messed up during an operation and he sued the hospital and won. Anything can happen once lawyers get involved, but even if the Walker family doesnât sue, youâre right, Rachel sure could. She tells her story to any lawyer in the country and theyâll have a lawsuit on the mayorâs desk by the next morning. But my point isnât that Rachel could sue. My point isnât even that Walkerâs family could sue. My point is, Dylan could be found innocent, or, you know, it could be ruled a justifiable homicide, because there was no reasonable legal recourse to the sexual assault.â
âYou watch too many lawyer shows,â Dez said.
âMaybe I do, but Lana Cassidy put us in an awkward position. I donât know why she wouldnât take Rachelâs statement.â
âItâs all CYA, Fenway. Human Resources isnât there to protect employees; itâs there to reduce the employerâs liability. She didnât want to open the county up for harassment claims. If she lets Rachel file, this is a government officeâthat shit goes public. It makes it hard to recruit new employees. Plus, itâs not like Walker could get fired. Itâs an elected position. Getting him out of there wouldâve meant convincing him to resign, or to, I donât even know, impeach him.â
âLana Cassidy covering her own ass resulted in Rachel getting sexually assaulted in the office. If I were Rachel, Iâd be calling Gloria Allred and negotiating book rights.â
âNice to know our new coroner is bitter and jaded like the rest of us.â Dez put a hand on Fenwayâs shoulder and smiled.
âAll right, enough jaded employee talk. Iâve got to figure out if Rachel sent the video file to anyone through email.â
âShe recorded it from her work computer?â
âYeah. All kinds of liability issues, right?â
âWell, yeah,â Dez shrugged. âBut you donât
